Police Stop Investigation, Owner Of JPK Group, Thedy Johanis and Johanis Found Not Guilty

BATAM, TRIBUNBATAM.id - The investigation into the case of alleged fraud in the sale and purchase of shophouses involving PT Jaya Putra Kundur (JPK) as developer and PT Mitra Raya Sektarindo (MRS) as contractor has officially been stopped. 

This termination was carried out through a Letter of Termination of Case Investigation (SP3) with number S.Tap/01./C/V/RES.2.2./2024/Ditreskrimsus Polda Kepri by Special Criminal Investigation Department of Regional Police Riau Island which was issued on May 27 2024. 

This case was terminated after Restorative Justice (RJ) legal action was initiated by the police against the person who report (Surlima) and (Joni Ong) owner of PT. MRS as Seller. Buyer & Seller Both parties, Surlima and Joni Ong, agreed to make peace. 

As for PT. MRS and PT. JPK also carried out peace agreement which was formalized through an Agreement Letter made at Notary Wahyu Hidayat's office on March 6 2024.

This agreement refers to the Deed of Cooperation Agreement Number 29 dated 18 May 2016 which was ratified by Notary and Land Deed Drafting Officer (PPAT), Tuti Rachmawati Lalo.

In this agreement, Djoni Ong, as a owner of PT MRS, is willing to pay the outstanding administration fee to PT JPK, paying off the owing amount of the remaining 45 outstanding properties' title deed out of a total of 65. 

After payment is completed, PT JPK (JPK Group) will issue a Power of Attorney to Sell for the 45 property title deeds.

The Director of Special Crimes (Dirkrimsus) of the Riau Islands Regional Police, Police Commissioner Putu Yudha Prawira, confirmed that the investigation into the case had stopped. 

"It's cleared and terminated. The basis for the dismissal is Restorative Justice. They have reconciled, then the reporter has withdrawn the report," he said, Tuesday (10/9).

Head of the PT JPK Legal Team, Dr. Zevrijn Boy Kanu, S.H, M.PdK, M.H. said, PT. JPK appreciates the actions of the Chief of Riau Islands Regional Police (Inspector General Police Yan Fitri) who straightened out this case. After the termintation letter was issued by the police, the suspect status and the Wanted List for his clients, namely THEDY JOHANIS and JOHANIS, were officially revoked. He wants to straighten out the problems that occurred to restore PT JPK's good name in the eyes of Public.

"PT JPK is the official land owner and the developer, while PT MRS is only a contractor. PT MRS sold the property without involving PT JPK. The land is under the name of PT JPK, but why are the directors and leaders of PT JPK being accused? That is the crux of the problem," said Dr. Boy Kanu is his nickname.

PT JPK did not know anything about the sale and purchase agreement between PT MRS and the shophouse buyers. 

"The person who received the money was PT MRS. They were also the ones who made the sale and purchase agreement without involving PT JPK. It is impossible for PT JPK, as a large developer since the 1970s, to commit fraud for just 3 shophouse units," he added.

According to Dr. Boy, this matter is more of a miscommunication. After going through the process at Police Headquarters, the case was declared a civil case, not a criminal case. With the termination of the case decision, PT JPK can restore the company's good name. 

Dr. Boy Kanu also revealed that PT JPK has contributed greatly to development in Batam City, including:
